1. Agreement to Terms

By accessing or using Kesslernity's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

Kesslernity provides hosted prompt library services for companies, including:

Custom prompt library development
Hosting and maintenance of prompt libraries
Branding customization
Regular updates and new prompt additions

3. User Responsibilities

When using our services, you agree to:

Provide accurate information when contacting us or signing up for services
Use the prompt libraries only for lawful purposes
Not share access credentials with unauthorized users
Not attempt to reverse engineer or copy our systems
Comply with all applicable laws and regulations

4. Intellectual Property

Our content: The Kesslernity website, branding, and original content are owned by Kesslernity and protected by intellectual property laws.

Your prompt library: Prompt libraries created for your company are licensed for your use. You may use the prompts internally within your organization as agreed in your service contract.

5. Payment Terms

Payment terms, pricing, and billing cycles will be specified in individual service agreements. All fees are non-refundable unless otherwise stated in your service agreement.

6. Service Availability

We strive to maintain high availability of our hosted services. However, we do not guarantee uninterrupted access and may need to perform maintenance or updates that temporarily affect service availability.

7. Limitation of Liability

To the maximum extent permitted by law, Kesslernity shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount you paid for our services in the twelve months preceding the claim.

8. Disclaimer

Our services are provided "as is" without warranties of any kind. We do not guarantee that the prompts will produce specific results, as AI outputs depend on the AI models used, which are operated by third parties (OpenAI, Anthropic, Google, etc.).

9. Termination

Either party may terminate services according to the terms specified in the service agreement. Upon termination, your access to the prompt library will be discontinued.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes. Your continued use of our services after changes constitutes acceptance of the new terms.

11. Governing Law

These terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation or, if necessary, through appropriate legal channels.
