Terms of Service

1. Agreement to Terms

These Terms of Service are an agreement between you and Kesslernity Limited ("Kesslernity", "we", "us"), a company established in the United Arab Emirates and the publisher of our products. By accessing this website, buying our products, or completing checkout, you confirm that you have read and agree to be bound by these Terms. If you do not agree, please do not use the site or buy the products.

2. Description of Products

Kesslernity offers free and paid digital products for Microsoft 365 Copilot teams and AI-at-work practitioners, including:

• Field guides and frameworks (Markdown and print-ready HTML)
• Paste-ready Copilot agent templates
• Rollout roadmaps, governance checklists, and ROI templates
• Books, kits, cheat sheets, and interactive tools
• Free downloadable resources and the AI at Work newsletter

Paid products are sold as digital downloads through our store at store.kesslernity.com, which is hosted on Gumroad. Free guides are also published on this website. Products are licensed, not sold: you acquire a license to use a product, not ownership of it or of the copyright (see Section 4).

3. Your Responsibilities

When you buy or use our products, you agree to:

• Provide accurate information when purchasing or contacting us
• Use the products only for lawful purposes
• Stay within the rights granted by the license tier you purchased (see Section 4)
• Keep the source-credit notice where the license requires it, and not remove or alter copyright or attribution notices except where your tier expressly allows co-branding
• Comply with all applicable laws and regulations

What you may do with a product depends on the tier you acquired. Under the standard Personal or Team tier you may not resell or redistribute the product. Higher tiers grant broader rights, as set out in Section 4 and, in full, in the License & Terms.

4. Product Licensing and Intellectual Property

Our content: The Kesslernity website, branding, and the products themselves are owned by Kesslernity Limited and protected by intellectual property laws. We retain all intellectual property rights except the license expressly granted to you.

Your license is tier-aware. When you buy a product you receive a non-exclusive license whose scope depends on the tier you purchased:

• Personal / Single-user and Team: for your own use, or your organization's internal use (up to the stated number of seats for Team). You may not resell, redistribute, rebrand, or publish the materials outside your organization.
• Trainer & Reseller: a premium tier that lets you sell paid training, courses, or workshops using the product, adapt and co-brand the content, and give the materials to your training participants across unlimited clients and cohorts. It does not let you resell the product itself as a product (listing or selling it, as-is or modified, on any store or marketplace), and you must keep a visible notice that the source is Kesslernity.

This is a summary only. The full grant, the tiers, and their exact conditions are set out in the License & Terms referenced in Section 5, which govern in the event of any difference.

5. License & Terms (Canonical Instrument)

The canonical, versioned instrument that governs the license grant and tiers is the Kesslernity License & Terms (reference KESS-LIC-2026-001), published at kesslernity.com/license. Where these Terms and the License & Terms differ on any licensing specifics — the license grant, the tiers, resale rights, or attribution — the License & Terms govern. The version of the License & Terms in force on the date of your purchase applies to that purchase.

6. Payment and Refunds

Purchases are one-time payments at the prices shown on the store, processed by Gumroad, our merchant of record for payment and first-line refund support. We do not collect or store your payment-card details. The products are instant digital downloads, and refunds are handled under Gumroad's refund policy. If a file is faulty, incorrect, or fails to download, contact mathieu@kesslernity.com and we will repair or refund it. Nothing here removes rights you have under the consumer law of your own country.

7. Delivery, Updates, and Availability

Products are delivered immediately through Gumroad by download link and email; please keep your own copy, as links may be time-limited. Where a product includes updates, updated files may be re-delivered to buyers through Gumroad as a courtesy, but updates are not guaranteed. We aim to keep this website and the store available, but we do not guarantee uninterrupted access and may perform maintenance that temporarily affects availability.

8. Informational Only; No Professional Advice

The products are for general information and education only. They are not legal, financial, tax, security, engineering, safety, or compliance advice, and your purchase does not make Kesslernity your advisor. Obtain qualified advice before acting. We do not guarantee specific outcomes, and Microsoft 365 Copilot and any other AI tools you use are operated by third parties whose behavior and pricing can change.

9. AI Outputs

Our products help you use AI tools. AI output can be inaccurate, biased, or out of date. You are responsible for verifying any output before relying on it and for every decision you make using it. You must not use the products, or any AI output derived from them, to make safety-critical, permit-to-work, legal, financial, or engineering decisions without qualified human review. AI prepares; you decide.

10. Disclaimer; "As Is" and No Warranty

The products are provided "as is" and "as available", to the maximum extent permitted by law, with no warranty of accuracy, completeness, currency, or fitness for a particular purpose. They are guidance and templates, not professional advice. Features, pricing, and product names change, and content may become outdated after purchase.

11. Limitation of Liability

To the maximum extent permitted by law, Kesslernity shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim. Nothing limits liability that cannot be limited by law.

12. Termination

We may suspend or revoke your license if you breach these Terms — for example, by using a product outside the rights granted by the tier you purchased, such as reselling or redistributing it where your tier does not permit that, or removing a required source-credit notice. Products you have lawfully purchased and downloaded remain yours to use within the license granted.

13. Changes to Terms

We reserve the right to modify these Terms at any time and will provide notice of significant changes. The version in force on the date of your purchase governs that purchase. Your continued use of our services after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the law of the United Arab Emirates, without removing mandatory consumer protections available to you in your own country. Gumroad is the merchant of record for payment and first-line refund and dispute support. Any disputes shall be resolved through good-faith negotiation or, if necessary, through the appropriate legal channels.
