These terms apply to all free and paid digital products offered at store.kesslernity.com and linked from this page. Products are licensed, not sold. The rights you hold depend on the tier you purchased (Article 3).
Article 1 — Definitions
- "Kesslernity", "we", "us" means Kesslernity Limited, the publisher of the Products.
- "Product" means any digital item we offer or sell: kits, books, templates, cheat sheets, and interactive tools.
- "You" means the person or organization that purchases or uses a Product.
- "License" means the permission to use a Product granted to you under these Terms.
- "Tier" means the license level acquired: Free, Personal / Single-user, Team, or Trainer & Reseller (Article 3).
- "Refresh commitment" means a block headed "Refresh commitment" on a Product's store listing, stating how often a refreshed edition of that Product is published and for how long (Article 8).
- "Checkout provider" means Gumroad, the merchant of record for payment and first-line refund support.
Article 2 — What you acquire (license, not sale)
You acquire a license to use a Product; you do not acquire ownership of it or of the copyright. Kesslernity retains all intellectual property rights except the license expressly granted here. The rights you hold depend on the Tier you purchased.
Article 3 — License tiers
3.1 Free resources. Free downloads (cheat sheets, checklists, samples, calculators). Use them personally or inside your business. Do not remove the source credit or present them as your own original work.
3.2 Personal / Single-user. The standard paid tier. For one person's use, or one organization's internal use where stated. You may use, adapt, and print the Product for your own work. You may not resell, redistribute, or deliver it as paid training to others.
3.3 Team. Covers up to the stated number of named people (for example, 10 seats) inside one organization, for that organization's internal use only. Not across separate companies; not public sharing. Otherwise as Personal (3.2).
3.4 Trainer & Reseller. A premium tier for using a Product as paid training for others. Under this tier you may:
- use the Product to deliver and sell paid training, courses, or workshops;
- modify and adapt the content to fit your training, and co-brand it with your own logo;
- give the materials to your training participants as part of the training you deliver;
- do all of the above across unlimited clients and cohorts.
Under this tier you may not:
- resell the Product itself as a product — you may not list or sell it, as-is or modified, on your own store or any marketplace;
- sublicense these rights, or remove all attribution.
Condition: you must keep a visible notice that the source is Kesslernity (for example, "Based on the [Product] by Kesslernity — kesslernity.com") wherever you use or distribute the materials.
Article 4 — Free (open-source) content versus paid Products
Some content is published free on GitHub under the Creative Commons Attribution-ShareAlike 4.0 license (CC BY-SA 4.0). That license governs those repository copies and permits reuse with attribution and share-alike.
The paid Products are separate, proprietary works governed by the Tier you purchased under Article 3. Purchasing a paid Product does not place it under CC BY-SA, and the CC BY-SA repositories grant no resale rights over the paid Products.
Article 5 — Informational only; no professional advice
The Products are for general information and education only. They are not legal, financial, tax, security, engineering, safety, or compliance advice, and your purchase does not make Kesslernity your advisor.
Obtain qualified advice before acting. You must not use the Products, or any AI output derived from them, to make safety-critical, permit-to-work, legal, financial, or engineering decisions without qualified human review. AI prepares; you decide.
Article 6 — AI outputs
The Products help you use AI tools. AI output can be inaccurate, biased, or out of date. You are responsible for verifying any output before relying on it and for every decision you make using it. No specific result or saving is guaranteed.
Article 7 — "As is"; no warranty
The Products are provided "as is" and "as available", to the maximum extent permitted by law, with no warranty of accuracy, completeness, currency, or fitness for a particular purpose. Features, pricing, and product names change; content may become outdated after purchase.
Article 8 — Delivery and updates
Products are delivered immediately through the Checkout provider by download link and email. Keep your own copy; download links may be time-limited. You may receive updated files at no additional cost as a courtesy; updates are not guaranteed.
A Product's store listing may carry a block headed "Refresh commitment". Where it does, that block states how often we publish a refreshed edition of that Product and for how long the commitment runs, and it forms part of these Terms for that Product. We are bound by the Refresh commitment published on that Product's listing on the date of your purchase. A refreshed edition covered by it is supplied to you at no additional cost, and it is a new edition of the same Product, not a new Product and not a second purchase. No other wording creates that obligation: a general mention of updates, of free updates or of future updates, anywhere in a listing or in marketing material, is descriptive and is not a Refresh commitment. Where a Product's listing carries no Refresh commitment, the paragraph above applies to that Product in full and updates for it remain a courtesy. Our obligation under a Refresh commitment is to make the refreshed edition available on that Product's existing download. We will try to tell you by email when one is published, and if you have opted out of our email the refreshed edition is still there in your Checkout provider library.
Article 9 — Refunds
The Products are instant digital downloads. Refunds are handled under the Checkout provider's (Gumroad's) refund policy. If a file is faulty, incorrect, or fails to download, contact mathieu@kesslernity.com and we will repair or refund it. Nothing here removes rights you have under the consumer law of your own country.
Article 10 — Limitation of liability
To the maximum extent permitted by law, Kesslernity is not liable for indirect or consequential loss, and its total liability for any claim is limited to the amount you paid for the Product. Nothing limits liability that cannot be limited by law.
Article 11 — Precedence
These Terms and the Tier you purchased govern your purchase and supersede any older or conflicting license notice contained in a bundled document (for example, a README, PDF, or DOCX inside a kit).
Article 12 — Acceptance and changes
By completing checkout you confirm that you have read and agree to these Terms. We may amend these Terms for future purchases. The version in force on the date of your purchase governs that purchase (Article 14).
Article 13 — Governing law
These Terms are governed by the law of the United Arab Emirates, without removing mandatory consumer protections available to you in your own country. The Checkout provider is the merchant of record for payment and first-line refund and dispute support.
Article 14 — License identification
These Terms are versioned. The governing version is the one whose reference, version number, and effective date appear at the top of this page; superseded versions are listed under Version History. To identify the terms that apply to a purchase, cite the document reference and version in force on the purchase date (for example, KESS-LIC-2026-001 v1.0), together with the Product and Tier.
Where enabled, a paid purchase may also carry a unique license key issued by the Checkout provider at checkout, which serves as proof of License and of the Tier acquired.

Version history
- v1.1 (KESS-LIC-2026-001), effective 22 August 2026. Adds a scoped refresh clause to Article 8. A Product's listing may now carry a "Refresh commitment" block, and where it does that block becomes part of these Terms for that Product. Products whose listing carries no such block are unchanged: updates for them remain a courtesy, exactly as in v1.0. The change was made so that a product can commit to a refresh schedule before purchase without that commitment reaching every other product on the store.
